Standard Competition Terms


1.Qualifying Persons

1.1 Vimtree LTD trading as winzee.co.za operate competitions – skill-based games resulting in the allocation of prizes in accordance with these terms and conditions on the website www.winzee.co.za

1.2 The Competitions are open to all persons aged 18 and over except Winzee.co.za employees.

1.3 Winzee.co.za reserves the right to close a customer’s account at any time, invalidate ticket numbers or prizes won if they feel the customer is abusing the services, being abusive to other customers or staff or they have the belief that it is not genuinely the customer that is entering.

1.4 You must be located within South Africa to enter.

1.5 By entering into a competition on winzee.co.za you agree to be contacted by email, text or phone to be informed of the latest draws.

1.6 WinZee shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be accessed on:

1.7 WinZee reserves the right to modify this agreement or any of its components at any time without prior notice, at its sole discretion.

2.Legal Undertaking

2.1 By entering a Competition the entrant (‘Entrant’, ‘you’, ‘your(s)’) will be deemed to have legal capacity to do so, you will have read and understood these terms and conditions and you will be bound by them and by any other requirements set out in any related promotional material.

2.2 Competitions are governed by South African Law and any matters relating to the Competition will be resolved under South African Law and the Courts of South Africa shall have exclusive jurisdiction.

2.3 In the event that you participate in a Competition online via the Website, and by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. Winzee.co.za will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.

3.Competition Entry

3.1 Competitions may be entered via the Website. Winzee.co.za, may run multiple competitions and may be operated at the same time and each Competition will have a specific prize.

3.2 Availability and pricing of Competitions is at the discretion of Winzee.co.za and will be specified at the point of sale on the Website.

3.3 Your Winzee.co.za Account(s) In order to enter a Competition, you will need to register an account with us online. When registering an account online you will be asked to provide an email address or sign in via a social media account, such as Facebook, Twitter or Gmail (‘Social Media Account’)

3.4 When playing a Competition online via the Website, follow the on-screen instructions to: (a) select the Competition you wish to enter and when you are ready to purchase your Ticket(s), provide your contact and payment details. You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition terms and conditions; (b) once you have purchased your Tickets, play the Challenge when your payment has cleared we will then contact you by email to confirm your entry into the Competition.

3.5 Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into WinZee Company bank account, the
details of which will be provided on request.

3.6 Winzee.co.za reserves the right to refuse or disqualify any incomplete entries if it has reasonable grounds for believing that an Entrant has contravened any of these terms and conditions.

3.7 To the extent permitted by applicable law, all entries become our property and will not be returned.

3.8 The Entrant can enter the competitions a maximum number of times as displayed on the individual prize page. The limit is per person. Maximum tickets purchased per person shown on each individual prize page. Maximum ticket numbers vary per competition based on number of tickets available/price of tickets. Any person found to be over the maximum tickets allowed in the draw will have the excess numbers removed and refunded.

3.9 The competition closes when the last number is taken, no more entries after this point will be accepted. We will also close a competition early if it does not sell out by the guaranteed draw date – ticket sales will close and we will draw the prize regardless of how many tickets are sold on the guaranteed draw date.

3.10 While we will make every effort to honour the displayed price, there are rare instances where we reserve the right to either refund all participants in the competition or allocate the entire prize pool to a single winner. In certain situations, we may choose to absorb the loss and cover any remaining balances ourselves. Regardless of the outcome, we ensure that every competition will have a winner selected through a random draw.

3.11 All entrants must create an account prior to entering, and supply an email address and contact telephone number to proceed in the competition.

4.Promotion Periods

4.1 Each Competition will run for a specified period. Please see each Competition for details of start and end times and dates (‘Promotion Period(s)’).

4.2 Once a prize draw date has been called and confirmed on the prize listing page, we will draw the prize on that date regardless of ticket sell out. Once a guaranteed draw date is set, we will not extend a competition.

5.Competition Judgement

5.1 Winzee.co.za, 100% random ball spinning machine will determine the winner of each competition. Every draw will be live streamed on Facebook.

5.2 In the event of the ball machine not being available, the online Google Random Number Generator will be used. This will be demonstrated live streamed on Facebook before entering the required numbers for that specific competition, ie 1 to 60, 1 to 500, 1 to 1000 etc.

5.3 Due to the nature of the winning judgement there will only be one 1st prize winner per competition. Some competitions may have runners up prizes.

5.3 Winzee.co.za will attempt to contact Winner(s) using the telephone numbers and email address provided at the time of Entry (or as subsequently updated) and held securely in our database. It is the Entrant’s sole responsibility to check and update these details. If for any reason they are taken down incorrectly, Winzee.co.za will not be held responsible. Entrants must carefully check their contact details have been recorded correctly.

5.4 Once a winner is drawn they will own the prize offered in the competition and we will make every effort to contact them until the prize is delivered. Under no circumstance will the prize be forfeited.

5.5 In the event that the Winzee.co.za closes a Competition early, the Winner will be selected from all valid and eligible entries received by Winzee.co.za prior to the date of closure.

5.6 All Entrants are automatically entered onto Winzee.co.za database for the purpose of conveying information as to the status of their Competition, as well as any future Promotions or Competitions offered by Winzee.co.za.

5.7 All prizes will be drawn regardless of ticket sell out on the guaranteed draw date as set/shown on the website. Cash alternatives are not offered in place of prizes. Draws are not extended past the guaranteed draw date.

6.Winner’s Details

6.1 All Winners will also be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by Winzee.co.za in connection with the Competition and in identifying them as a winner of a Competition.

If the winner really does not want a photo taken then we will respect that but for the good of the competition and benefit of other entrants a photo of the winner and their prize would be nice.

6.2 Following receipt and verification of the details requested above by Winzee.co.za, the Winners will be contacted in order to make arrangements for delivery of the prize.

7.Competition Prizes

7.1 Winzee.co.za prizes are determined, selected by the managing directors of the company and are owned by Winzee.co.za from the date of the competition going live on the website to the date that the winner receives the prize. All prizes are picked and purchased by Winzee.co.za and in that case this is the prize the winner will receive. Details of each prize can be found on the website on the competition’s pages. Winzee.co.za take no responsibility of the prize awarded after delivery, once the winner receives the prize Winzee.co.za does not insure the prize. No insurance comes with the prizes and Winzee.co.za cannot be held responsible for the prize once handed over to the winner.

7.2 Delivery to the winner is free. However, Winzee.co.za reserves the right to impose delivery fees on the winner if they request the prize to be delivered outside of South Africa.

7.3 All entrant expenses are the sole responsibility of the Winners.

7.4 All prizes are subject to the terms and conditions of the prize provider, manufacturer or supplier.

7.5 Each Prize must be accepted as awarded and is non-transferable or convertible to other substitutes and cannot be used in conjunction with any other vouchers, offers or discounts, including without limitation any vouchers or offers of Winzee.co.za or other prize suppliers.

9.Winners’ Personal Data

9.1 Acceptance of the prize by the Winner will mean they are required to have their photo and video taken by Winzee.co.za for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with rule 6.2, unless prohibited by law.

9.2 By entering a Competition, you agree to the use of your name and/or photograph or other likeness to be used for marketing purposes as required by Winzee.co.za if you are declared a Winner.

10. Limits of Liability Winzee.co.za makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of Winzee.co.za , Winzee.co.za shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by Winzee.co.za , or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by Winzee.co.za .

11. Electronic Communications In the event that Winzee.co.za closes a Competition early, the Winner will be selected from all valid and eligible entries received by Winzee.co.za prior to the date of closure. Winzee.co.za shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. Winzee.co.za shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket recorded in our systems, however displayed or calculated, shall be entered into the relevant Competition and Winzee.co.za shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event.

12. Data Protection Notice Any personal data that you supply to Winzee.co.za or authorise Winzee.co.za to obtain from a third party, for example, a credit card company, will be used by Winzee.co.za to administer the Competition and fulfil prizes where applicable. In order to process, record and use your personal data Winzee.co.za may disclose it to (i) any credit card company whose name you give; (ii) any person to whom Winzee.co.za proposes to transfer any of Winzee.co.za rights and/or responsibilities under any agreement Winzee.co.za may have with you; (iii) any person to whom Winzee.co.za proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of Winzee.co.za in any country; and (v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data Winzee.co.za may need to transfer such information outside of South Africa, in which event Winzee.co.za is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.

13.Refunds/Return Policy

13.1 All Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date or if the Promoter cancels the competition.

13.2 Every participant agrees that the standard obligation as per the Consumer Protection (Distance Selling) regulations, requiring goods and services ordered online to be delivered within 30 days, will not be applicable to the WinZee Prize Competition. WinZee will make every effort to ensure the product is delivered within the 30-day timeframe, provided that we can successfully contact the winner and arrange for timely delivery of the prize. But this is not a guarantee.

14. Payment gateway security

14.1 Card acquiring and security: Card transactions will be acquired for WinZee via Yoco who are the approved payment gateway for all South African Acquiring Banks. DPO Yoco uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.Yoco.com/za/ to view their security certificate and security policy.

14.2 Customer details separate from card details: Customer details will be stored by WinZee separately from card details which are entered by the client on DPO Yoco ’s secure site. For more detail on DPO Yoco refer to www.Yoco.com/za/.

14.3 Merchant Outlet country and transaction currency: The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

14.4 Responsibility: WinZee takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

14.5 Country of domicile: This website is governed by the laws of South Africa and WinZee chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

15. Governing Law and jurisdiction

These terms and your use of this website are governed by and construed in accordance with laws of The Republic of South Africa and any disputes will be decided only by the courts of The Republic of South Africa.
15.1 Regulation of Interception of Communications (RIC) Act 70 of 2002. You hereby provide us with permission in terms of Section 4(1) of the Act to intercept any communication by accepting these terms and conditions
and using the WINZEE website you agree to the writing requirements imposed by the Act.
15.2 Electronic Communications and Transactions (ECT) Act 25 of 2002. Section 21 of the Act requires WINZEE to reach agreement as to the transmission of data messages and by using the WINZEE website you agree that:
• this agreement is concluded in Cape Town South Africa
• data messages addressed by you, can only be deemed to have been received by WINZEE
• if they have been responded to.
• an automated response, generated by WINZEE’ systems shall not constitute a response to you.
15.3 You agree that data messages sent to WINZEE from a computer, IP address or mobile device normally used by you, was sent or authorised to be sent by you personally.

15.4 WinZee functions as an innovative online platform centred around skill-based competitions, employing a unique raffle concept to engage participants. Here’s how it works: individuals can acquire numbered tickets through purchase, which in turn grants them entry into the competitions and the opportunity to vie for enticing physical prizes.

It’s essential to clarify that WinZee distinguishes itself from traditional gambling or lottery platforms. Unlike those, WinZee operates outside the regulatory purview of the National Gambling Act 33 of 1996 and does not hold a license from the National Gambling Board of South Africa. Instead, it offers a dynamic and skill-based experience where participants can test their abilities and potentially walk away with exciting rewards, all within a legal framework that emphasizes fair play and entertainment.

16. Data Protection and Protection of Personal Information

By providing us with any information you will be agreeing to the provisions set out below, together with any other terms you have agreed with WINZEE where relevant. Please ensure you have read and understood these terms before you
send WINZEE any information. This will apply to any information you have already provided. If you are a member of WINZEE, details of the information we collect and how we use it will also be set out in the terms and conditions of the relevant product or service. In the event of a conflict between this Data Protection Policy and the terms and conditions of your specific product or service, the terms and conditions of your specific product or service will take precedence. We reserve the right to revise or supplement this Data Protection Policy from time to time at our sole discretion, and you agree to revisit this policy regularly to ensure you are familiar with the most current version. By continuing to deal with us you will be agreeing to any such change. You must not send us personal information about someone else without first getting his or her consent for it to be used and disclosed in the ways set out in this terms and conditions. This is because we will assume he or she has consented although we may still ask for confirmation from them. Where you do give us information about someone else, or someone else discloses a connection with you, that information may be taken into account with your other personal information. We treat your privacy very seriously and we understand that you will wish to know how we will use the information we collect from or about you. We use your personal information in accordance with this Data Protection Policy and will fully comply with all applicable South African data protection legislation (including the Electronic Communications and Transactions Act 25 of 2002 – ECTA and the Protection of Personal Information Act, No 4 of 2013 – POPI). It is important that you take all necessary and appropriate steps to protect your data yourself (for example, by ensuring that all passwords and access codes are kept secure).

17. Information that may be collected

Policy number, Title, name and surname, Identification or Passport number, Date of birth, Contact numbers, E-mail addresses, IP address and Username and Password.

18 .Use of information collected

We may process, transfer and disclose your information for the purposes of:
18.1 providing you with services, managing your policies and complying with your instructions;
18.2 verifying your identity;
18.3 detecting and preventing fraud;
18.4 compliance with laws and public duties;
18.5 monitoring and/or recording your telephone calls and electronic transactions in order to accurately carry out your instructions;
18.6 market research and providing you with information via email, telephone or other means about WINZEE’ products or services from time to time; direct marketing purposes via email, telephone or other means.
18.8 The processing, transferring or disclosing of your information as set out above will be undertaken strictly in accordance with ECTA and POPI.

19. Email

The information contained in this email is confidential and may contain proprietary and/or personal information. It is meant solely for the intended recipient. Access to this email by anyone else is unauthorised. If you are not the intended recipient, any processing of the email or the information contained therein (including disclosure, copying, distribution, storage) or any action taken or omitted in reliance on this, is prohibited and may be unlawful. No liability or responsibility is accepted if information or data is, for whatever reason corrupted or does not reach its intended recipient. No warranty is given that this email is free of viruses. The views expressed in this email are, unless otherwise stated, those of the author and not those of WINZEE or its management. WINZEE reserves the right to monitor, intercept and block emails addressed to its users or take any other action in accordance with its internal IT policies. Emails are tracked by WINZEE for analytical purposes namely to determine how the recipient engages in the email e.g.) whether or not the email was delivered, opened, read or forwarded.

20. Access rights

You have a right to access the personal data that is held about you. To obtain a copy of the personal information WINZEE holds, you can contact WINZEE’ member services division and upon an identity verification process, this information will be provided to you.

21. Security

We take all reasonable steps to secure the contents of the WINZEE website and the information provided by and collected from users. We do not however make any warranty or representation that the content of this website is 100% safe and secure.

22. Disclaimer

We specifically state that the information contained on this website is intended exclusive for jurisdictions falling inside the Republic of South Africa, and any products or services offered on this website are intended for the Republic of South Africa only. Those who access this website do so on their own initiative, and are therefore responsible for compliance with applicable local laws and regulations. By accessing each part of this website, the entrant has agreed that he/she has reviewed the website in its entirety including any legal or regulatory terms.

23. Awarding prizes

When it comes to awarding prizes, we operate on a fair and transparent basis. Once a winner is selected, they have a generous window of 30 days to claim their prize. This period kicks off from the initial draw date of the competition, ensuring ample time for the winner to come forward and collect their reward.

To ensure the smooth retrieval of prizes, we make multiple attempts to reach out to the winner via email and SMS, providing ample opportunity for communication. However, we understand that circumstances can vary, and sometimes, despite our efforts, we may not immediately receive the necessary information from the winner. In such cases, if a dialogue is ongoing, we remain flexible and may extend the 30-day window from the date of our last conversation.

It’s important to note that adherence to our terms and conditions is paramount. If we find that the winner has not met the requirements outlined in our terms and conditions for participation on WinZee, we may request additional information to ensure compliance before finalizing the prize award process. This commitment to fairness and integrity ensures that all participants have an equal opportunity to enjoy the benefits of our platform.
